Effective Date: October 6, 2026
These Terms of Service (“Terms”) govern your use of cholostacos.com (the “Website”) and any food-ordering, pickup, delivery, payment, communication, or related services offered by Cholo’s Tacos, operated by Cholos Tacos Company (“Cholo’s Tacos,” “we,” “us,” or “our”).
By accessing the Website or placing an order, you agree to these Terms. If you do not agree, do not use the Website or place an order through it.
You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order through the Website.
You agree to provide current and accurate contact, payment, pickup, and delivery information. You are responsible for reviewing your order before submitting it.
We make reasonable efforts to display accurate menu descriptions, prices, photographs, ingredients, and availability. However:
If an ordered item is unavailable, we may contact you to approve a substitute, remove the item, provide store credit, or issue a refund for the unavailable item.
Food is prepared in an environment where meat, dairy, wheat, gluten, eggs, soy, nuts, shellfish, and other allergens may be present.
We cannot guarantee that any menu item is completely free from allergens or cross-contact. Menu descriptions and statements made by the Website, employees, contractors, or automated assistants are not medical advice or an allergy guarantee.
Customers with a serious food allergy should contact us directly before ordering. If we cannot safely accommodate a request, we may decline or cancel the affected item.
The Website may use an automated or artificial-intelligence assistant to explain menu items, collect order information, or help customers build an order.
Automated responses may contain errors. Your final checkout screen, order confirmation, and receipt control if they conflict with a prior automated response.
An order is not accepted until you receive an order confirmation. Adding items to a cart or speaking with an automated assistant does not reserve those items or guarantee availability.
You are responsible for checking the final order details, including items, quantities, meat choices, modifications, pickup location, pickup time, delivery information, and total price before paying.
Prices are listed in U.S. dollars. Applicable taxes, service charges, delivery fees, processing charges, and optional tips will be shown before payment when required.
Prices offered through third-party platforms may differ from prices offered directly by Cholo’s Tacos.
Tips are voluntary unless a mandatory service charge is clearly disclosed before purchase.
Payments may be processed by Square or another authorized third-party payment provider. Cholo’s Tacos does not directly control the payment provider’s systems or security practices.
By submitting payment information, you represent that:
Your use of a payment provider may also be governed by that provider’s terms and privacy policies.
Contact us immediately if you need to change or cancel an order.
An order may be changed or canceled for a full refund only if food preparation has not started. Once preparation begins, the order is final and normally cannot be canceled, changed, or refunded.
Submitting a request does not guarantee that an order can be changed or canceled. A change or cancellation is effective only when confirmed by Cholo’s Tacos.
Because our products are prepared food, all sales are final once preparation begins, except when:
Problems should be reported as soon as reasonably possible on the same day the order is received. We may request the receipt, order number, photographs, or return of the affected item before providing a remedy.
Depending on the circumstances, we may offer a replacement, correction, store credit, partial refund, or full refund. Approved card refunds will be returned to the original payment method when reasonably possible. Financial institutions may require several business days to post a refund.
We do not provide refunds for:
Nothing in this section limits any non-waivable rights available under applicable law.
Pickup estimates are approximate and are not guaranteed. Delays may occur because of order volume, equipment issues, ingredient availability, weather, staffing, or other circumstances.
Customers are responsible for arriving at the correct location and collecting orders within a reasonable time. Food quality and food safety may decline when an order is collected late.
We are not responsible for loss, theft, spoilage, or reduced food quality after an order has been made available for pickup and the customer fails to collect it on time.
Delivery is available only when specifically offered during checkout. Estimated delivery times are not guaranteed.
You must provide an accurate and accessible delivery address, contact number, and necessary delivery instructions. Additional charges or order cancellation may result from incorrect information, an inaccessible location, or an unsuccessful delivery attempt.
Third-party delivery services may apply their own terms, fees, refund rules, and privacy practices.
Promotions, coupons, loyalty rewards, and special offers:
We may refuse or cancel a promotion that was obtained or used through fraud, manipulation, technical error, or violation of its stated conditions.
If you provide contact information, we may use it to communicate about your order, payment, pickup, delivery, customer-service request, or account.
Marketing messages will be sent only when legally permitted or when you have provided the required consent. Consent to receive marketing messages is not required to purchase food.
Message and data rates may apply. You may opt out of promotional text messages by replying STOP. Transactional communications concerning an active order may still be sent when necessary.
You may not:
We may restrict access, reject orders, or cancel transactions involving suspected fraud, abuse, threats, harassment, or unlawful conduct.
The Cholo’s Tacos name, logo, mascot, artwork, videos, menu designs, photographs, audio, Website content, and other branding are owned by or licensed to Cholo’s Tacos.

The Website may connect to payment processors, map providers, social-media platforms, delivery services, or other third-party services.
We are not responsible for third-party websites, service interruptions, content, security, policies, or actions. Your use of those services is governed by their own agreements.
We do not guarantee that the Website, automated assistant, ordering system, payment system, audio, video, or other features will always be available or error-free.
We may modify, suspend, or discontinue any Website feature when reasonably necessary. If a technical problem affects a paid order, contact us so we can review the transaction.
To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available.”
We do not make warranties regarding uninterrupted access, error-free operation, or the accuracy of automated responses, estimated preparation times, photographs, or third-party services.
This disclaimer does not exclude warranties or consumer rights that cannot legally be waived.
To the fullest extent permitted by law, Cholo’s Tacos will not be liable for indirect, incidental, special, or consequential damages arising from use of the Website or a third-party service.
For a claim concerning an order, our total liability will not exceed the amount the customer paid for the affected order, except where a different limitation is required by law.
Nothing in these Terms excludes liability that cannot legally be limited, including liability arising from gross negligence, intentional misconduct, or other non-waivable obligations.
To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful use of the Website, fraudulent activity, violation of these Terms, or infringement of another person’s rights.
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
Before filing a legal claim, you and Cholo’s Tacos agree to make a reasonable good-faith effort to resolve the issue directly.
Unless applicable law requires otherwise, legal proceedings relating to these Terms or an order must be brought in a court with jurisdiction in Douglas County, Oregon.
We may update these Terms from time to time. Updated Terms will be posted on the Website with a revised effective date.
Changes apply prospectively and do not alter the terms governing an order completed before the updated Terms became effective.
If any portion of these Terms is found unenforceable, the remaining provisions will continue in effect. An unenforceable provision will be interpreted as closely as legally permitted to its intended purpose.
These Terms, together with any posted Privacy Policy, Refund Policy, promotional conditions, and checkout disclosures, constitute the agreement between you and Cholo’s Tacos concerning the Website and online orders.
